These Terms govern your access to and use of our digital platforms, as well as the purchase of all fresh, made-to-order culinary products from Atayeb Khadijah (“Company”, “we”, “us”, or “our”). By placing an order or accessing our services, you (“Customer”, “you”) agree to be bound by these legally binding Terms.
1. Introduction & Contract Formation
1.1 Scope of Agreement
These Terms apply to all sales of goods, including but not limited to fresh pastries, ma’amoul, fatayer, gift sets, and related delicacies sold by Atayeb Khadijah.

- Order Placement: Placing an order via our online store or authorized messaging channels constitutes an offer by you to purchase products in accordance with these Terms.
- Order Acknowledgment: Upon receipt of your order, we will issue an automated acknowledgment. This acknowledgment does not constitute legal acceptance of your offer.
- Binding Contract: A legally binding contract is formed only when we issue a formal Order Confirmation or when preparation of your fresh items commences, whichever occurs first. We reserve the right to decline any order prior to confirmation at our sole discretion.
2. Made-to-Order & Lead Times

- Advance Notice: All standard orders require a minimum lead time of 24 hours advance notice prior to the requested delivery or collection window.
- Bespoke & Catering Orders: Large-scale, corporate, or special event orders require advance notice as specified during booking and may be subject to separate written agreements.
- Schedule Capacity: As our products are prepared fresh daily in limited quantities, daily order capacity is capped. Acceptance of orders is subject to kitchen availability.
3. CRITICAL: Allergen & Health Disclaimer
3.1 Presence of Known Allergens
- Tree Nuts (including pistachios, walnuts, pine nuts, and almonds)
- Sesame Seeds & Sesame Products (including tahini)
- Gluten / Wheat
- Dairy & Milk Derivatives (including clarified butter)
- Eggs
3.2 Cross-Contamination Warning
While we uphold strict kitchen hygiene standards, we cannot guarantee a completely allergen-free environment. Airborne particles, shared prep equipment, and raw ingredient handling mean cross-contamination may occur.
3.3 Customer Responsibility
- Mandatory Disclosure: You must notify us in writing of any severe food allergies, dietary restrictions, or medical conditions prior to confirming your order.
- Consumption Risk: If you or any recipient of your order suffers from a severe, life-threatening allergy (including, but not limited to, severe nut or gluten anaphylaxis), you purchase and consume our products entirely at your own risk. Atayeb Khadijah explicitly disclaims all liability for adverse allergic reactions.
4. Pricing, Payment & Tax
4.1 Currency & Pricing
All prices listed on our platform are expressed in Qatari Riyal (QAR) unless explicitly stated otherwise. We reserve the right to modify prices at any time without prior notice; however, price changes will not affect orders that have already been confirmed.

- Full payment must be cleared prior to order preparation.
- We accept major credit cards, debit cards, and approved digital payment gateways.
- By submitting payment details, you confirm that you are authorized to use the designated payment method. Payment processing is handled by secure third-party payment service providers.
5. Delivery, Pickup & Risk Transfer
5.1 Delivery Obligations
- Accuracy of Information: You are solely responsible for providing complete, accurate delivery details (including recipient name, phone number, street address, and building numbers).
- Recipient Availability: You must ensure that the recipient or an authorized representative is present at the designated delivery address during the agreed delivery window.
5.2 Transfer of Risk & Spoilage
- Risk Transfer: Risk of damage, loss, or deterioration of perishable products passes entirely to the Customer upon handover by our courier at the specified delivery address.
- Unattended Deliveries / Failed Handoffs: If a delivery attempt fails due to an incorrect address, lack of access, or recipient unavailability, the courier will attempt contact. If unsuccessful, the products will be returned or disposed of. No refunds or complimentary re-deliveries will be granted for failed handoffs.
5.3 Force Majeure & External Delays
Atayeb Khadijah shall not be held liable for delivery failures or delays caused by events outside our reasonable control (“Force Majeure”), including extreme weather, traffic blockades, road closures, civil disturbances, or severe disruption to local logistics networks.
6. Cancellations, Refunds & Perishable Goods Exemption

- Cancellation Window: Orders may only be cancelled or modified at least 24 hours prior to the scheduled delivery date.
- Late Cancellations: If a cancellation request is submitted after baking or ingredient preparation has begun, the order cannot be cancelled, and no refund or credit will be issued.
6.3 Damaged, Defective, or Incorrect Items
- Notification Window: You must contact our customer support team within two (2) hours of receipt.
- Required Evidence: You must provide clear photographic or video evidence showing the affected product and packaging.
- Remedies: If Atayeb Khadijah verifies that the product was damaged or incorrect prior to risk transfer, we will, at our discretion, provide a replacement item, a partial store credit, or a refund for the affected item.

8. Limitation of Liability & Indemnification
8.1 Liability Cap
To the maximum extent permitted by applicable law, the total cumulative liability of Atayeb Khadijah, its owners, employees, and agents for any loss or claim arising out of or related to these Terms, the website, or our products shall be strictly limited to the total purchase amount paid by the Customer for the specific order giving rise to the claim.

- Your failure to disclose relevant severe allergens prior to order confirmation;
- Misuse or improper storage of perishable products after delivery.
9. User Conduct & Account Security
9.1 Acceptable Use
- Submit false or fraudulent orders;
- Attempt to bypass security measures or access non-public server areas;
- Use automated bots, scrapers, or software to extract data from our site.
9.2 Account Security
If you create an account on our platform, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
10. Governing Law & Dispute Resolution
10.1 Applicable Law
These Terms, their subject matter, and any contractual or non-contractual disputes arising from them shall be governed by and construed in accordance with the Laws of the State of Qatar.
10.2 Informal Resolution
10.3 Jurisdiction
If an informal resolution cannot be reached within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of the State of Qatar.
